ONE ITEM, REGULAR AGENDA ITEM NUMBER ONE, AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 78 TO AMEND TECHNICAL STANDARDS OF PERSONAL WIRELESS SERVICE FACILITIES.

AND THIS ITEM IS FROM THE CITY.

UM, YES, SO WHAT WE HAVE BEFORE YOU THIS EVENING IS, UH, REVISIONS TO OUR PWSF ORDINANCE.

UM, NEXT SLIDE PLEASE.

I, SO I'M GONNA GO OVER BRIEFLY THE CURRENT, UM, PWSF ORDINANCE APPROACH.

UM, WHY THE NEED FOR THE CHANGE, UH, PRIMARY GOALS OF AN ORDINANCE, AMENDMENT, THE APPROACH, AND THEN THE PROPOSED MEETING SCHEDULE.

SO CURRENTLY THE CURRENT PWSF ORDINANCE, UH, APPROACH IS A TIER SYSTEM.

WE HAVE THREE TIERS CURRENTLY.

UH, TIER ONE IS, UH, AN EXPEDITED REVIEW.

UM, THIS WOULD BE, UH, IMPROVEMENTS TO EXISTING POLES, UH, ROOF MOUNTED EQUIPMENT.

TIER TWO IS A LITTLE MORE EXTENSIVE REVIEW.

THIS WOULD INCLUDE, UH, INSIDE CHURCH STEEPLES.

UM, ON TVA TRANSMISSION TOWERS, TIER THREE IS

OUR LEAST PREFERRED AND TYPICALLY AVOIDED A TIER.

UM, THIS WOULD INCLUDE, UM, STRUCTURES WITHIN THE FLOODPLAIN, STEEP HILLSIDES, RESIDENTIAL LOTS, AND ALL GROUND MOUNTS EXCEEDING 42 FEET.

SO THAT'S OUR CURRENT TIER SYSTEM WITHIN THE PWSF ORDINANCE.

UM, THE CURRENT REQUIREMENTS ALSO, UM, REQUIRE DISGUISE TECHNIQUES.

UM, AND THEY ALSO REQUIRE THE HEIGHT OF STRUCTURES TO BE SIMILAR TO, TO THE SURROUNDING, UH, STRUCTURES.

BASICALLY, UM, WE AVOID OR PROHIBIT LATTICE STRUCTURES UNDER THE CURRENT ORDINANCE, AND WE HAVE A FALL ZONE REQUIREMENT OF 110% OF THE TOWER HEIGHT.

AND THEN THEY ALSO HAVE TO COMPLY WITH CURRENT SETBACK REQUIREMENTS.

SO WHY DO WE NEED A CHANGE HERE IN BRENTWOOD? SO, UM, WE HAVE SIGNIFICANT WIRELESS GAPS IN OUR COVERAGE, UH, SPECIFICALLY IN THE EAST, UM, EAST OF WILSON PIKE AREA, THE CITY, AND, UM, THAT RESULTS IN POOR SERVICE TO NO SERVICE AND FRUSTRATED RESIDENTS.

UM, THE WIRELESS SERVICE GAPS, UH, AFFECT EMERGENCY CALL CAPABILITIES.

UH, THEY AFFECT BUSINESS ACTIVITY AND ROU ROUTINE RECREATIONAL USES, UH, AS WELL, OUR PW PWS OR ORDINANCE WAS ADOPTED IN 2001.

UM, AND IT'S PROVEN TO BE OUTDATED AND HAS HINDERED, UH, NEED NEEDED WIRELESS INDUSTRY FACILITY INVESTMENT IN BRENTWOOD OVER MANY YEARS.

UM, WE FEEL THAT THIS HAS CONTRIBUTED TO THE GAPS.

IT'S BEEN MORE DIFFICULT FOR NEW TOWERS TO BE PLACED IN BRENTWOOD.

SO THE NEXT SLIDE WILL SHOW AN EXAMPLE OF, UM, THIS WAS A PROPOSAL ACTUALLY, UM, AN ANTENNA UPGRADE THAT WAS, UH, THAT CAME BEFORE YOU SEVERAL MONTHS AGO.

SO YOU HAVE PRE AND POST CONDITIONS THAT THE, THE IMAGE ON THE LEFT SHOWS THE PRE-CONDITION AND THEN, UH, THE POST ON THE RIGHT, YOU SEE THE ADDITIONAL GREEN AREA.

SO THAT WAS THE IMPROVEMENT THAT WAS MADE WITH THE ADDITIONAL ANTENNAS PLACED ON AN EXISTING TOWER.

UM, THE NEXT SLIDE IS VERY SIMILAR AS WELL.

UM, IT SHOWS THE A, A VERY GOOD NEED ON THE LEFT, THE PRECONDITION, AND THEN THE BENEFITS OF THE POST-CONDITION, UM, WITH THE UPGRADED ANTENNA.

UM, SO I'LL COME BACK TO THAT HERE IN A MINUTE.

BUT THAT SLIDE'S, UH, IMPORTANT.

SO THE PRIMARY GOALS OF THE ORDINANCE AMENDMENT IS TO, UH, BETTER ALLOW THE WIRELESS COMMUNICATION INDUSTRY TO ADDRESS THE WIRELESS SERVICE GAPS IN BRENTWOOD AND PROVIDE WIRELESS SERVICES, UM, THAT THE COMMUNITY DESERVES.

UM, ALSO TO ENHANCE BRENTWOOD RESIDENTS CAPABILITY TO CALL FOR EMERGENCY SERVICES WORK REMOTELY AND USE WIRELESS SERVICES FOR RECREATIONAL PURPOSES.

UM, IT ALSO CONTINUES, UH, OR TO CONTINUE TO REASONABLY RESTRICT ALLOWABLE LOCATIONS FOR COMMUNICATION TOWERS TO CONTINUE TO PRESERVE AND OR ENHANCE SITE SAFETY AND TO CONTINUE TO PRESERVE AND OR ENHANCE SITE AESTHETIC COMPATIBILITY.

SO THE APPROACH THAT WE'RE TAKING WITH THE ORDINANCE AMENDMENT IS TO, UH, RETAIN THE EXISTING TIER SYSTEM, BUT ADD A NEW TIER FOUR, A SUBCATEGORY TIER FOUR, AND THIS WILL ALLOW NEW MONOPOLE STRUCTURES, UH, NOT TO EXCEED 160 FEET, UH, SUBJECT TO VERY DEFINED CRITERIA.

UM, SO THE CRITERIA WOULD INCLUDE, UM, THE APPLICANTS MUST DEMONSTRATE A NEED.

SO THINK BACK TO THOSE IMAGES OF THE COVERAGE, UM, SO THAT YOU HAD, YOU HAD GAPS IN THE COVERAGE WITH THE PRECONDITION, AND THEN THEY'RE GONNA SHOW A POST-CONDITION, THEY'RE GONNA SHOW A NEED.

UM, THE OTHER THING THAT IT REQUIRES IS THAT IT GIVES US THE AUTHORITY TO REQUIRE A THIRD PARTY REVIEW.

SO THEY'RE GONNA SUBMIT A PROPAGATION STUDY SHOWING A NEED.

WE WILL HAVE A THIRD PARTY REVIEWER LOOK AT THEIR STUDY AND AGREE THAT, THAT IT DOES IN FACT SHOW A NEED.

UM, ANOTHER, ANOTHER CHANGE OR PROPOSAL WITH A TIER FOUR IS, UH, THE PROPERTY SITES WILL NEED TO BE OWNED OR LEASED BY A GOVERNMENT OR A QUASI-GOVERNMENT ENTITY, SUCH AS A PUBLIC UTILITY DISTRICT OR BY A RESIDENTIAL HOMEOWNER'S ASSOCIATION.

SO, UM, COMMON OPEN SPACE

PROPERTY TIER FOUR WOULD REQUIRE INTERNAL WIRING AND STEALTH AND CAMOUFLAGE DESIGN SUBJECT TO PLANNING, COMMISSION, REVIEW AND APPROVAL.

SO THE IMAGE ON THE FAR LEFT IS A LATTICE STRUCTURE.

THOSE WILL NOT BE ALLOWED, UH, MONOPOLES WOULD BE ALLOWED.

UM, SOME DISGUISED TECHNIQUES MAY INCLUDE TREES, FLAGPOLES OR A MONOPOLE THAT'S PAINTED, UH, TO BLEND IN, UM, SOMEWHAT WITH A SKY OR WHATEVER.

UM, SO THE OTHER THING THAT'S GONNA BE REQUIRED, REMEMBER I MENTIONED THAT THE CURRENT ORDINANCE REQUIRE HAS A FALL ZONE REQUIREMENT, 110% OF THE TOWER HEIGHT.

SO WITH A TIER FOUR, WE'RE GONNA REQUIRE THAT THOSE TOWERS BE ENGINEERED, UH, WITH PINCH POINTS, SO THEY COLLAPSE UPON THEMSELVES.

SO, UM, THERE'S AN EXAMPLE OF A TOWER THAT HAS COLLAPSED UPON ITSELF.

UM, ALSO, UM, WE'RE GONNA REQUIRE THAT THEY ACCOMMODATE CO-LOCATION OR MULTIPLE SERVICE PROVIDERS ON ONE TOWER.

THIS WILL REDUCE THE NUMBER OF TOWERS WITHIN THE CITY.

UM, IT WILL REQUIRE A VISUAL IMPACT ANALYSIS.

UM, SO THE APPLICANT IS GOING TO, UH, PROPOSED SCREENING THAT TO THE GREATEST EXTENT POSSIBLE.

AND THAT PROPOSAL WILL BE REVIEWED BY THE PLANNING COMMISSION.

UM, IT WILL HAVE TO MEET ALL CODES AND REQUIREMENTS.

AND, UM, IN ADDITION, WE'RE GONNA REQUIRE THAT THE APPLICANT NOTIFY RESIDENTS WITHIN A THOUSAND FEET, UH, WITH CERTIFIED NOTIFICATIONS, JUST MAKING THEM AWARE OF THE PROPOSAL.

AND THAT'S A THOUSAND FEET WITHIN THE SITE.

UM, SO THE COMPOUND AREA, THE FENCED AREA OF THE TOWER, UM, WE'RE GONNA, UH, REQUIRE NOTIFICATION OF, OF THE RESIDENCE WITH WITHIN A THOUSAND FEET.

UM, IN CONCLUSION, UM, THE PROPOSED MEETING SCHEDULE, THE NEXT MEETING WILL BE THE PUBLIC HEARING BEFORE THE CITY COMMISSION ON FEBRUARY 9TH.

AND THEN WE HAVE SECOND AND FINAL READING ON MONDAY, FEBRUARY 23RD.

SO THIS NEW TIER FOUR WILL, WILL MAKE A NEW TIER, UH, A NEW TOWER EASIER, UH, TO GET APPROVAL.

IF, IF THEY SHOW THE NEED, THEY SHOW THE NEED AND, UM, IT ALLOWS THEM TO DO, DO A TALLER TOWER THAN THE EASIER THAN THE CURRENT ORDINANCE ALLOWS.

THE, THE REQUIREMENT THAT THEY NOTIFY NEIGHBORS WITHIN A THOUSAND FEET IS THAT IN ANY OF THE CURRENT STANDARD IT IS NOT.

OKAY.

SO THAT'D BE AN ADDITIONAL REQUIREMENT OF THEM BEYOND CURRENT ADDITIONAL FOR THE T UH, THE TIER FOUR.

YEAH.

'CAUSE THEY'RE NOT SOMETHING WE SEE VERY, THERE ARE, UM, THEY'RE NOT, UH, SIGNIFICANT, IF YOU WILL, UM, FOR, UM, FOR GOVERNMENT PROPERTY THAT ABUTS RESIDENTIAL, YOU'RE GONNA HAVE A BUFFER.

YOU'RE GONNA HAVE A BUFFER OF, UH, 50 OR 75 FOOT, AND THEN YOU'RE GONNA HAVE A SETBACK OF, I THINK IT'S A HUNDRED FOOT.

AND THEN FOR, UH, RESIDENTIALLY ZONE PROPERTY, UH, LIKE HOA OPEN SPACE, UM, YOU'RE, IT'S PROBABLY GONNA BE MORE LIKE 35 OR 40 FOOT FROM THE PROPERTY LINE WOULD BE THE MINIMUM SETBACK.

BUT THAT'S THE BOUNDARY OF THE OPEN SPACE.

WILL WE HAVE THE ABILITY TO SAY THAT THAT IMPINGES ON THE OTHER PROPERTY? WE WILL, THERE WILL BE ESTABLISHED, ESTABLISHED SETBACKS FOR THE ZONING DISTRICT.

A QUICK NOTE TO THAT AS WELL AS IF, IF THE APPLICATION IS GONNA BE IN A, A RESIDENTIAL HOA, UH, OPEN AREA, UM, OBVIOUSLY THEY'LL HAVE TO, AS A SELF-GOVERNING ENTITY, THEY'LL NEED TO WORK WITH THEIR HOMEOWNERS BECAUSE THEY'RE NOT GONNA DO ANYTHING THAT'S GONNA UPSET THEIR HOMEOWNERS THERE.

BUT THE SECOND PART TO THAT IS, IN THAT SCENARIO, BECAUSE OF THE ZONING, THAT'S A, THAT ONE, THAT PROCESS IS ADDS ANOTHER STEP, WHICH IS TO BRING BACK TO THE ZONING ASPECT OF IT.

SO YOU GET KIND OF TWO BITES TO THE APPLE THAT'LL NEED TO RUN FAIRLY CONCURRENTLY WITH THAT ONE.
